BlendedIQ.ai – Terms of Service

Effective Date: 5 August 2025

These subscriber terms of service ("Terms") govern your use of all products and services provided by BlendedIQ.ai (collectively, the "Services"). By creating an account, activating a free trial, or purchasing a subscription you agree to be bound by these Terms and to our Privacy Policy and Cookie Policy (together, the "Agreement"). If you do not agree, do not access or use the Services.

IMPORTANT – ARBITRATION & CLASS‑ACTION WAIVER Section 19 explains how disputes will be resolved. Please read it carefully.

  1. Our contract with you
  1. These Terms form a legally binding contract between you ("Subscriber," "Customer," or "you") and Kisito Futonge (trading as BlendedIQ.ai) ("BlendedIQ," "we," or "us").
  2. You affirm that (a) you are at least 18 years old (or the age of legal capacity in your jurisdiction) or that you have parental consent, and (b) you have authority to enter this Agreement.
  3. Your electronic assent has the same legal effect as a hand‑written signature.
  4. These Terms are provided in English. If we provide a translation, the English version will control in the event of any conflict.
  1. Who we are & how to contact us
  • Legal status & address. BlendedIQ.ai is owned and operated by Kisito Futonge, a sole trader based in Ireland. Business address: Newbridge, Ireland.

  • When we use "writing" or "written," we mean email unless we say otherwise.
  1. Your personal data

We use your personal data only as described in our Privacy Policy. You can update marketing preferences by emailing [email protected].

  1. Our right to make changes

We may modify these Terms or the Services to reflect legal, technical, or business developments. We also anticipate incorporating a limited company in the future; if and when that occurs, we will update these Terms to identify the new legal entity, and your rights and obligations under this Agreement will continue uninterrupted. Material changes will be notified at least 30 days in advance by email or in‑app notice. Continued use after the effective date constitutes acceptance. If you do not agree, you must cancel before the change takes effect.

  1. The Services

The Services provide short, modular online courses, interactive exercises, assessments, and related resources designed to develop AI fluency ("Micro‑Courses"). You need compatible hardware and internet access, and you are responsible for all charges related thereto.

  1. Accounts, membership & plans
  1. Subscriptions. We offer monthly, quarterly, annual, and enterprise plans (each a "Plan"). Details, including price and features, are shown at checkout.
  2. Free trial. New customers may receive a 30‑day trial. Unless you cancel before the trial ends, we will begin billing the selected Plan immediately beyond the trial.
  3. Family / Team accounts. The primary account holder ("Owner") may invite additional users. Invited users have separate learning records, but the Owner controls billing and may add or remove users at any time. Cancellation by the Owner terminates all linked accounts.
  4. Lifetime access. From time to time we may offer a one‑time "lifetime" license. Lifetime access is contingent upon at least one login in any rolling 12‑month period. We may deactivate dormant lifetime accounts.
  5. Third‑party vouchers. Voucher codes may grant limited access (e.g., one course). Further use requires a paid Plan.
  1. Billing & payment
  1. Billing cycle. Subscription fees are charged in advance on the calendar day corresponding to the start of your paid Plan. If a billing date does not occur in a given month (e.g., 31 April), we bill on the last day of that month.
  2. Payment methods. You must provide a valid payment method ("Payment Method"). By submitting a Payment Method you authorise us to charge it for the fees and applicable taxes. We may place a nominal refundable charge to verify the Payment Method.
  3. Failed payments. If payment fails we may retry the Payment Method, use any backup method you have provided, suspend access, and/or employ collection services. You remain responsible for unpaid amounts.
  4. Price changes. We may change Plan prices with at least 30 days’ notice. Changes apply from the next renewal after the effective date.
  1. Cancellation, pause & reactivation
  • Cancel anytime. You can cancel in your dashboard under Settings › Membership & Payments or by emailing support @blendediq.ai. Cancellation takes effect at the end of the current paid period. We do not provide pro‑rated refunds except where required by law.
  1. Refund policy
  • Digital content. Once digital content (e.g., downloadable workbooks, certificate PDFs) has been accessed, you waive any statutory "cooling‑off" right to cancel.
  • EU/UK consumers. If you are a consumer resident in the EU or UK, you have a 14‑day right to withdraw from online service contracts. However, you expressly request immediate access to the Services and acknowledge that you lose that right once full performance has begun.
  1. Passwords & account security

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate access to protect you or us from fraud.

  1. User responsibilities & restrictions

You agree not to:

  • Share, sell, or transfer your account or content to any person or entity;
  • Circumvent or disable any content‑protection system;
  • Reverse‑engineer or decompile any part of the Services;
  • Upload viruses, malicious code, or engage in activity that interferes with or disrupts the Services;
  • Use the Services to infringe intellectual‑property rights, violate privacy, or engage in unlawful conduct.
  1. Availability & maintenance

We strive for 99.5 % uptime but do not guarantee uninterrupted service. Planned maintenance will be scheduled outside Irish business hours where possible.

  1. Third‑party links & content

Links to third‑party sites are provided for convenience. We do not endorse or control those sites and are not responsible for their content or practices.

  1. Disclaimers

The Services are provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non‑infringement. We do not guarantee that learning outcomes or career results will be achieved.

  1. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Services will not exceed (a) the fees you paid to BlendedIQ in the three months preceding the event giving rise to the claim, or (b) €200, whichever is greater. We are not liable for indirect or consequential losses (e.g., lost profits, data, or business opportunities).

  1. Indemnity

You will defend and hold harmless BlendedIQ, its owner, contractors, employees, and agents from any third‑party claims arising out of your breach of this Agreement or misuse of the Services.

  1. Survival

Sections 11–18 and any other provisions which by their nature should survive, shall survive termination.

  1. Assignment

You may not assign or transfer this Agreement without our prior written consent. We may assign this Agreement in connection with a merger, acquisition, or sale of assets.

  1. Complaints, arbitration & dispute resolution
  1. Informal resolution. Please contact [email protected] first; most issues can be resolved quickly.
  2. EU ODR platform. If you reside in the EU you may use the ODR platform at https://ec.europa.eu/consumers/odr.
  3. Governing law & venue. Unless a mandatory law says otherwise, this Agreement is governed by Irish law and disputes will be resolved in the courts of Dublin, Ireland. If you are a consumer and mandatory law requires your local courts to have jurisdiction, nothing in this clause deprives you of that protection.
  1. Injunctive relief

Unauthorised use of the Services may cause irreparable harm. We may seek injunctive relief without posting a bond.

  1. Severability

If any provision is held invalid, the remaining provisions shall remain in full force and effect, and the invalid provision shall be interpreted to fulfil its intended purpose to the maximum extent permitted.

  1. Entire agreement

This Agreement constitutes the entire understanding between you and BlendedIQ regarding the Services and supersedes all prior agreements, whether written or oral.
